Please carefully review the following Terms and Conditions (“T&Cs”) that govern the use of services provided by Jakuna Travel LLC (hereinafter referred to as "Jakuna," "we," "us," or "our"). These T&Cs, along with any applicable terms from our suppliers, constitute a binding legal agreement between you and Jakuna Travel LLC. By accessing or using our services, you acknowledge and agree to be bound by these T&Cs, as well as by our Privacy Policy. If you do not agree to all the terms herein, you may not use or access our services in any manner.

All references to “you” or “your” in these T&Cs include the primary individual accessing or using the services, as well as all individuals on whose behalf a booking is made (e.g., travelers under the same booking). 

By requesting, accessing, or using our services through our website or agents, you confirm and agree that:

1. You have read and accepted these T&Cs, and you agree to be bound by them;

2. You are of legal age of majority in your country or state of residence; and

3. If you are requesting services on behalf of others, you have the legal authority to bind those individuals, including the assumption of all obligations on their behalf, and you are solely responsible for informing such persons about the applicable T&Cs.

If you do not agree to all of these terms without modification, you must not access or use our services.

Requesting a Trip 

By contacting Jakuna Travel LLC, you agree to allow us to communicate with you via email, phone, or other methods with your consent to organize a trip. You acknowledge that Jakuna Travel LLC does not own or operate any of the entities providing services for your trip. Instead, Jakuna Travel LLC arranges guide services, accommodations, activities, transportation, and other services from various third-party vendors worldwide. We reserve the right to maintain the confidentiality of our vendors.

Confirmation of Trip & Payment Terms 

To confirm a trip, you must remit payment in accordance with the instructions provided by Jakuna Travel LLC. All inclusions and exclusions, as well as the total trip price will be listed on the proposal sent by us. Jakuna Travel LLC is under no obligation to provide a breakdown in costs of any travel itinerary. We reserve the right to amend the prices of unsold travel arrangements at any time and to correct errors in confirmed arrangements.

The following payment terms apply:

1. If the trip start date is more than 90 days away: A deposit of 30% is required at the time of booking, with the remaining balance due 90 days before the start date.

2. If the trip start date is less than 90 days away: Full payment is required at the time of booking.

These payment terms may be amended on a case-by-case basis, and you will be informed prior to processing payment. Payment can be made via wire transfer, or credit card with a surcharge. Failure to make timely and complete payment may result in cancellation by you, and you will be subject to cancellation charges as outlined in the “Changes & Cancellations By You” of this T&C’s.  Once the deposit or full payment is processed, we will send you a confirmation e-mail of receipt of payment.

Jakuna Travel LLC does not typically charge a planning fee. However, on occasion, a planning fee may be requested. This fee will be deducted from the total cost of the booking if the trip is confirmed. If the trip is not confirmed and the planning fee has been paid, the fee will be non-refundable.

In the event of a chargeback or payment dispute, you agree to first attempt to resolve the matter with Jakuna Travel LLC before initiating any third-party action. If a chargeback is initiated without prior communication, Jakuna Travel LLC reserves the right to pursue any unpaid amounts through legal action, including the recovery of associated fees and expenses.

In the event that flights are part of your itinerary, Jakuna Travel LLC will inform you of the airline providing the service. While flight details will be provided, they are subject to change by the airline. Your contract for flights is directly with the airline and is subject to the airline’s terms and conditions. You are responsible for checking in for your flights in a timely manner. Jakuna Travel LLC does not assume responsibility or accept claims in regards to name changes, schedule changes, flight changes or cancellations, and any other service that's provided by the airline

Insurance 

We suggest that you purchase comprehensive travel insurance that covers trip cancellation or interruption, medical emergencies or issues, lost belongings, repatriation, and evacuation. We are not qualified or authorized to answer any technical questions about insurance. We suggest considering “cancel for any reason” coverage. If you choose to travel without adequate insurance, Jakuna Travel LLC is not liable for any losses you may incur. Our liability to you is limited by the insurance coverage you are required to maintain, and this requirement is an essential part of our agreement.

Additional Services 

If you request additional services before or during your trip, we will provide a quote for the requested services. Payment authorization by credit card must be obtained before arranging any new services. All additional services are subject to these T&Cs upon confirmation.

Passport, Visa & Entry Requirements 

It is your responsibility to ensure that your passport, visa, health, and immigration requirements are in compliance with the itinerary. We may provide general information; however, the ultimate responsibility for ensuring compliance with all relevant regulations, including vaccination and travel requirements, rests with you. Jakuna Travel LLC is not responsible for any travel disruptions caused by failure to meet such requirements.

Age requirements

All travelers must be 18 years of age or older, unless accompanied by a legal guardian or an appointed escort over the age of 18 designated by the legal guardian. The legal guardian or appointed escort will be responsible for travelers under 18. Please note that certain activities within the itinerary may have different age restrictions, which will be communicated at the time of booking.

Substitution of Traveler 

If requested, we will attempt to substitute an existing traveler for a new one, but we cannot guarantee our ability to do so. In either case, you will be responsible for any fees or surcharges incurred from the substitution.

Changes & Cancellations By You

Any requests for changes to confirmed travel arrangements must be made in writing and acknowledged in writing by Jakuna Travel LLC. We cannot guarantee that changes can be accommodated but will make reasonable efforts to assist. You will be responsible for any costs or fees incurred due to changes, including potential airfare, touring, and hotel rate increases.

We understand sometimes your plans change and you need to terminate your travel arrangements before a trip starts or while you are traveling. In the event of a full or partial cancellation of travel, you must notify us in writing. No refunds will be issued for passengers who do not travel or for unused services. The following cancellation charges apply:

• More than 60 days prior to the trip start date:  a termination fee equal to the deposit amount paid will be forfeited.

• 60-30 days prior to the trip start date:  a termination fee equal to the 50% of the total trip costs will be forfeited.

• Less than 30 days prior to the trip start date: a termination fee equal to the 100% of the total trip costs will be forfeited.

Certain destinations or arrangements may have stricter cancellation policies, which will be communicated to you at the time of booking.

We request you to purchase travel insurance for your trip. If the reason for your cancellation is covered under the travel insurance terms, you may be able to reclaim these charges to your insurance. 

Changes & Cancellations By Jakuna Travel LLC

Jakuna Travel LLC reserves the right to make changes or cancellations to your confirmed travel arrangements, including but not limited to accommodation, transportation, touring schedules, guides, and service providers. Changes will be communicated via email. If a travel service is canceled, an alternative will be offered. Should you decline the alternative, you may request a refund only for the specific canceled service.  If you choose to cancel the entire trip, it will be treated as a cancellation by you, and the applicable cancellation fees will apply as outlined in the 'Changes & Cancellations By You' section of these Terms & Conditions.

Unforeseen events beyond Jakuna Travel LLC control, such as transportation delays or hotel issues, may occur. You agree that Jakuna Travel LLC is not responsible for such unanticipated and unexpected changes, and that any costs and expenses resulting from such changes or cancellation will be your sole responsibility.

Force Majeure 

In the event of force majeure, Jakuna Travel LLC will not be responsible for any refunds or compensation, and any costs arising from such events will be the sole responsibility of the traveler. Force majeure includes but is not limited to natural disasters, war, government action, civil unrest, terrorism, pandemics, or other unforeseeable events.

You acknowledge that travel to some destinations may involve a higher degree of risk, including health risks, personal safety, and other hazards. By booking with Jakuna Travel LLC, you voluntarily assume all such risks and agree that Jakuna Travel LLC shall not be held liable for any harm, injury, or losses incurred.

Traveler Obligations 

You agree to take full responsibility for your actions and welfare, including but not limited to unforeseen events, illness, injury,  death, and theft. You release Jakuna Travel LLC, its agents, employees, and affiliates from any liability arising from your trip. This release is binding on your heirs and assigns to the fullest extent permitted by law.

As a traveler, you are expected to behave responsibly and adhere to local laws and customs. You will be held accountable for any damages, fines, or other consequences resulting from your actions during the trip. Jakuna Travel LLC is not liable for any personal misconduct or incidents arising from your behavior, and you agree to release Jakuna Travel LLC from any responsibility or liability related to such matters

Severability

If any provision of these T&Cs is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect

Arbitration Notice

By agreeing to these T&Cs, you agree that all disputes arising out of or relating to these T&Cs or your trip shall be resolved through binding individual arbitration under the rules of the State of Florida, and governed by the laws of the United States of America. You waive your right to participate in a class action lawsuit or class-wide arbitration. 

Liability Release and Limitation

You acknowledge that Jakuna Travel LLC does not own or operate any of the entities providing services for your trip. Instead, Jakuna Travel LLC arranges guide services, accommodations, activities, transportation, and other services from various third-party vendors worldwide.

In no event shall Jakuna Travel LLC liability exceed the total amount paid by you for the trip. Under no circumstances shall Jakuna Travel LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your trip

Arbitration Notice

All claims or disputes arising out of or relating to any travel services provided by Jakuna Travel LLC, including but not limited to any claims regarding payments, itinerary changes, cancellations, or refunds, shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in the state of Florida, and the laws of Florida shall govern the arbitration proceedings.

All client claims must be submitted in writing and received by Jakuna Travel LLC no later than thirty (30) days after the completion of the booked travel itinerary. Claims not submitted and received within this timeframe will be deemed waived and barred.

Changes to T&Cs 

Jakuna Travel LLC reserves the right to revise or update these T&Cs at any time. Any material changes will be posted on our website. Continued use of our services following any changes constitutes your acceptance of the revised T&Cs.
